The defendant Jones and the victim Smith are in a bar. Smith and his friends get into an argument with some other patrons at a table next to Jones. A fight breaks out, and at one point another patron involved in the fight punches Smith in the face. As a result of the punch, Smith falls backwards towards Jones. Jones then pushes Smith from behind to keep Smith from falling into him. Smith then falls forward and hits his head on the floor. Smith sustains bleeding in the brain and dies later that night in the hospital. Jones is charged with involuntary manslaughter. Jones plans to testify that he acted in self-defense when he saw Smith falling in his direction. At trial, the prosecution calls the medical examiner to testify about his autopsy findings. The Doctor testifies that the bleeding in Smith’s brain was caused by blunt force trauma to the head. He also testifies that the bleeding was caused by either the initial punch to Smith’s face, or as the result of falling and hitting the floor after Jones pushed him. The Doctor is unable to say which of these blows was the more probable cause of the bleeding, although he does testify that it is possible that the bleeding began only after Smith hit the floor.

When the prosecution rests, Jones’ counsel files a motion for a judgment of acquittal on the involuntary manslaughter charge, arguing that the government has failed to prove sufficient evidence to sustain a conviction. In assessing a motion for judgment of acquittal, the court must assess whether the prosecution offered sufficient evidence that would allow a reasonable jury to conclude each element is established beyond a reasonable doubt.
